1. Introduction
Welcome to CalmCommonsGarden ("we," "us," "our"). These Terms & Conditions ("Terms") oversee your engagement with our nautical charter services and our website located at calmcommonsgarden.sbs, operated by CalmCommonsGarden.
By initiating a charter or utilizing our Service, you consent to be legally bound by these Terms. If you do not consent to any part of these terms, you are prohibited from using the Service.
2. Service Overview
CalmCommonsGarden provides first-class yacht rental services, inclusive of, but not limited to:
- Yacht charters for the day
- Twilight sea voyages
- Business getaways
- Exclusive gatherings
- Extended sailing adventures
Services are provided subject to availability and meteorological conditions. We claim the right to change or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For charter reservation, you must:
- Be at least 18 years old
- Ensure information provided is correct and thorough
- Settle the prescribed advance payment as indicated in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Your reservation is only assured following payment and our written acknowledgement. We reserve the discretion to deny service to any person.
3.3 Availability
All yacht charters are contingent on the availability of vessels and favorable weather. We will endeavor to fulfill your requested dates and times within reason.
4. Payment Terms
4.1 Pricing
Prices are presented in € and encompass all relevant taxes unless stated otherwise. Prices are amendable without prior notice.
4.2 Payment Schedule
- Initial Deposit: 50% of the entire charter fee payable upon reservation
- Final Payment: Due no later than 48 hours prior to the yacht's departure
- Extra costs (if applicable): Payable after the charter completion
4.3 Payment Methods
Major credit cards, bank transfers, and certified cheques are accepted. Payment transactions are secured through encrypted methodologies.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Full reimbursement minus processing charges
- 24-72 hours before departure: 50% refund
- Less than 24 hours before departure: No reimbursement
5.2 Weather Cancellations
Should weather be considered unsafe by our captain, we present the choice to:
- Reschedule your charter to another available slot without extra charge
- Grant a full refund if rescheduling isn't feasible
5.3 Mechanical Issues
In case of mechanical malfunctions with the designated yacht, we will strive to offer an appropriate substitute. If no replacement is found, a full reimbursement will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Adhere to all commands from the crew
- Don safety gear when indicated
- Inform about any health conditions impinging on their safety
- Stay within assigned areas on board
6.2 Prohibited Items
The subsequent items are forbidden on the yacht:
- Glassware
- Illegal substances
- Weapons or firearms
- Drinks beyond moderate consumption levels
- Pets (excluding pre-authorized cases)
6.3 Conduct
Passengers are expected to act in a mannerly fashion. We retain the right to halt a charter without refund if a guest's behavior is deemed a safety threat or disrupts other patrons.
7. Liability and Insurance
7.1 Our Liability
We are liable only up to the cost of your yacht charter. We are not accountable for:
- Injuries due to guests' recklessness
- Loss or damage to personal belongings
- Indirect, consequential, or exemplary damages
- Delays induced by weather or factors outside of our governance
7.2 Insurance Coverage
Maritime insurance that spans our vessels and activities is up to date. Clients are responsible for their travel and personal insurance.
7.3 Assumption of Risk
By partaking in charter services, you recognize that nautical engagements inherently pose risks and you assume responsibility for your own safety and welfare.
8. Modifications and Itinerary Changes
Iterative alterations to itineraries, courses, or schedules may arise due to weather patterns, safety priorities, or operational demands. Feasible alternate experiences will be sought in every possible situation.
9. Force Majeure
Non-accountability exists for postponements, cancellations, or alterations brought upon by events beyond our influence, including, but not limited to:
- Extreme weather occurrences
- Natural disasters
- Government mandates
- Port shutdowns
- Tech
